Michael C. Poliner concentrates on government contract law, export control law, and related compliance and litigation matters. His export control work includes compliance matters under the State Department’s International Traffic in Arms Regulations (ITAR) and the Commerce Department’s Export Administration Regulations (EAR), related internal investigations, commodity jurisdiction determinations, and corporate training.

Mr. Poliner’s government contracts practice includes claims before the Boards of Contract Appeals and the United States Court of Federal Claims and bid protests before the General Accounting Office and courts. Many of his cases have involved computers and other technology issues. He also has appellate experience in the United States Court of Appeals for the Second Circuit, the District of Columbia Circuit, and the Federal Circuit. Among other accomplishments, he argued the winning appeal in Northrop Grumman Corp. v. Goldin, 136 F.3d 1479 (Fed. Cir. 1998).

Working in the federal arena has also permitted Mr. Poliner to become experienced in the negotiation of government contract-related joint ventures, teaming agreements, and subcontracts. He has also handled issues involving licensing, protection of data rights, government cost accounting, negotiations with federal agencies over the terms of solicitations, and foreign military sales (FMF and FMS).

Mr. Poliner started his legal career in 1980 in the Hartford, Connecticut office of Day, Berry & Howard, where he concentrated on litigation. In 1985, he joined the Washington, D.C. office of Fried, Frank, Harris, Shriver & Jacobson, where he worked on many aspects of government contracts and export control compliance matters. He continued that practice with Feith & Zell, P.C. for the next decade. Mr. Poliner and Mr. Luks formed Poliner & Luks LLP as of January 1, 2002.

Mr. Poliner is a member of the District of Columbia bar and a member of the American Bar Association and its Section on Public Contract Law. He holds a J.D. and a B.A. (with high honors) from the University of Virginia, where he was elected Phi Beta Kappa.
